		<description><![CDATA[Healthcare: Judge rules Obama healthcare law unconstitutional &#8211; latimes.com Reporting from Washington —A federal judge in Florida dealt President Obama&#8217;s healthcare overhaul another legal blow Monday, ruling that the entire law is unconstitutional because of a requirement in the legislation that Americans get health insurance starting in 2014. U.S. District Judge Roger Vinson&#8217;s widely anticipated decision goes beyond a separate ruling by a federal judge in Virginia who last year ruled only that the insurance mandate is unconstitutional. In separate lawsuits, two other federal courts have ruled that the law and its insurance mandate are permissible under the so-called Commerce Clause of the Constitution. The divided opinions set the stage for a potentially landmark constitutional debate in the higher courts, with a final decision expected in the U.S. Supreme Court, perhaps as soon as next year. 		<description><![CDATA[Washington, DC&#8211; In 1994 Feinstein told us that the 3 Millions Acres she closed us out of in the Mojave Desert was all that was needed to protect future generations. Then again in 2006 she came back and took more Millions more from public access.And then again in 2008 and 2009 when she bull shitted Bush and Obama respectively. This week Senator Feinstein has basically asked Congress that the rest of the Mojave Desert be closed off to public use. Oh she figure if she cuts out of her Empire a couple of thousand acres here and there for the Off road crowd so we will shut up. But this has more importance than my use of a quad. Closing off the desert to potential energy and mineral development is sentencing America to the continued spiral to 3rd world status. Not only is this an obscene example of over reach, the Bitch lied. She said  she had enough, but no, she wants to screw the Nation out of all its resources.  She provides no opportunity for Private exploration of mineral resources nor does she tell us how taking millions of square miles of the west off the potential tax rolls [...]

		<description><![CDATA[County in Utah wins title to R.S. 2477 roads &#124; Christian Probasco &#124; NewWest.Net By Christian Probasco A significant victory on road ownership for a southern Utah county could establish a precedent that could alter the way wilderness is designated in the West. The recognition of Kane County’s title to the historic “Skutumpah Road” in a district court case by Judge Clark Waddoups, and subsequent recognition of its title to four more routes, has given representatives of Kane County hope they may finally get a fair hearing on the issue of road ownership, even from employees of the federal government which is fighting them on the issue. Michael Swenson, executive director of the pro-access group Utah Shared Access Alliance (USA-All), which supported Kane County’s suit, says, “Judge Waddoups rendered a fair and reasonable verdict. We believe he applied the law as it was intended.” Since the Aug. 30 victory on the Skutumpah Road and later favorable verdicts, Kane County has sued for quiet title to 49 more roads. R.S. 2477 Highways Kane County’s arguments for road ownership are based on R.S. 2477, a civil war-era statute that was repealed under the Federal Land Policy and Management Act of 1976 (FLPMA). [...]

		<description><![CDATA[Clean Energy Can&#8217;t Compete The solar company Evergreen announced last week that it is shutting its Massachusetts plant and will lay off 800 workers.  That&#8217;s the same plant Massachusetts Governor Deval Patrick had state taxpayers fund in 2007 to the tune of $58 million in grants, loans and land and tax incentives &#8212; one of the largest investments in a private company in Bay State history, says the Wall Street Journal. Evergreen blames its plant closing on competition from subsidized Chinese manufacturers.  However, Evergreen has also been subsidized in the multiple ways that federal and state governments favor solar power, says the Journal. Bay State taxpayers are now stuck with the losses. Mr. Patrick says he intends to claw back some of that $58 million, but Evergreen says it does not owe more than $4 million. Taxpayers will also be thrilled to know the state is so worried about getting a new tenant for the manufacturing site that it may let Evergreen keep its sweetheart $1-a-year lease &#8212; allowing the company to sublet it at a profit. That&#8217;s enough to make anyone feel ill, but it&#8217;s only a start. Obamacare eventually will impose nearly two dozen new or higher taxes on the American public, according to Americans for Tax Reform, which calls the new rules that took effect Jan. 1 the &#8220;medicine cabinet tax.&#8221; This penalty hits many everyday items in the ordinary household. Until now, Americans could use Health Savings Accounts (HSAs) and Flexible Savings Accounts (FSAs) to pay, pretax, not just for major medical care and prescription drugs but also for nonprescription, over-the-counter medicines. Shughart II Washington Examiner Environmental Protection Agency officials Wednesday provided power companies and states with new guidance on EPA’s plans to regulate greenhouse gases. A D.C. lobbyist for two major power companies told Bloomberg News that “the energy and manufacturing sectors will essentially be in a construction moratorium” as a consequence. Here we are, with 15 million Americans unemployed and millions more underemployed, and the EPA is moving blindly ahead with new regulations that will increase dramatically the energy costs of U.S. industries, reducing their competitiveness and profitability, and making it less likely they will hire. EPA’s action amounts to rewriting the Clean Air Act to suit its own bureaucratic and ideological objectives. At a time when the Obama administration should be focused on job creation and the nation’s economic recovery, promulgating stringent new environmental rules should be its last priority. The new EPA rules call for a reduction in the national ambient air-quality standard for ground-level ozone, a precursor of smog, from 75 parts per billion to between 60 and 70 parts per billion, a cut of up to 20 percent. And how has the recovery been going? The National Bureau of Economic Research, a private organization, has declared that, according to their measures the recession ended in June 2009. Since then, we supposedly have seen over a year of &#8220;recovery.&#8221; How bad the recession has been depends on what you look at. The Carter recession during the early 1980s produced a higher unemployment rate, with unemployment rising to a peak of 10.8 percent compared with the peak this time of 10.1 percent. The recent recession also did not come close to reaching the 14 percent annual inflation rate that we reached during the end of 1980. On the other hand, the recent drop in GDP was larger. The three worst quarters of this recession saw drops in GDP of 6.8, 4.9, and 4 percent, exceeding the 6.5, 4.9, and 3.2 percent drops during the early 1980s.
