Attorney General’s Final Notice to Theatre 29…May Lose Tax-Exempt Status & Face Penalties

Twentynine Palms, Ca.,- Let’s examine another problem facing Theatre 29 that appears to be ignored in hopes that it will all go away all by itself. Theatre 29 touts it is a non-profit 501(c)(3) but has not been in compliance for several years. The last time I reviewed the sweetheart contract from the City of Twentynine Palms for the yearly rent of $1.00, this agreement was made with the understanding Theatre 29 was a non-profit in good standing, but that is not the case according to the Attorney General:

Records indicate the Attorney General issued a First Notice to Comply to Theatre 29 on August 18, 2011>Theatre2955820549[1].

In a past email to the President of the Board, Brian Tabeling, I brought this matter to his attention they have been out of compliance with their non-profit status and sent him a copy of the above Second Notice letter. Here is the email exchange>Theatre29_Email_exchanges_2012

Theatre 29 has received FOUR notices from the Attorney General ordering to comply or lose their tax exempt status.>29_DOJ_Details_Page

During these past weeks examining Theatre 29′s practice of misrepresenting their ticket sales, reviewing their tax filings and asking about the “$18,000 Grant to hire an architect” (which there is NO record of >Theatre29_PRA_Mar_2012)…..the Attorney General also issued their FINAL NOTICE to comply last month.

 

Theatre 29 has crossed the line with the Attorney General facing loss of their tax exempt status and penalties. The Board of Directors will each be held responsible for this non-compliance according to the Department of Justice.

  1. This directly reflects on a disgraced city council because they look the other way, while pandering to a non-profit in bad standing by continually ponynig up perks and public funds to an errant bunch of self-righteous playhouse cronies.

    Time for a taxpayers law suit naming all five council people and the President of Theatre 29 as respondents.

    Do you really want another four years of mismanagement; incompetence; shameful cronyism; a city council of rogue leaders; a council that abuses power; a council that misuses public resources; violation(s) the Brown Act; spin and disinformation; a council of two elitists and snobs (Harris and Mintz); Cronies Serving Cronies; bad stewardship; a dictatorial regime; financial deficits; no spending cuts or fiscal accountability; a city floundering in red ink, the loss of $600,000 to a million dollars a year per Ron Peck (financial officer); more public funds going out for unnecessary pet projects for special people, than money coming in; plundering public funds and taxes intended for public safety not going for public safety?

    Oh…The Stench of local Politics: The arrogance. The calamity of the demise of the TPFD.

Tell me about the theater people wanting a new theater at public expense when they are in bad standing with the and out of compliance with California law and the AG. lets talk about their lying to the city when they have breached their contract about keeping in good standing. Lets talk about council members looking the other way.

    This city council is a compete failure and a public disgrace, as well as just batch of cronies that have plunder public funds such that the city is completely swimming in red ink in 45 days. Larry talk to me!

      • Your hilarious Larry. Do you disagree with Ron Peck that the city in 45 days will have a deficit, be in the red, have more money going out than coming in; and this year for the first time the $600,000-$1,000,000 in left over annual funds will not be there.

        Do you disagree that public safety is more important than the a playhouse?
