In 1996 California voters passed the Compassionate Use Act which allows for the personal use of marijuana for certain medical illnesses. Investigators determined during their investigation that Arizona residents were purchasing marijuana from California dispensaries. The customers were providing the owner/operator of the dispensary with a California Identification Card with a California address when they in fact, live in Arizona. In addition to selling marijuana to Arizona residents, investigators determined many of the dispensary owners and operators are also full-time residents of Arizona. California medical marijuana laws specifically pertain to California residents only. The individuals identified through this investigation are circumventing California law by making false claims of residency. The Sheriff’s Department frequently investigates marijuana dispensaries that are not in compliance with state laws.
