98732fcd89d0ce28_landingI know what it is like waking up one morning and thinking you have the world by the sack and it’s just a matter of time that with firm pressure the world will come into compliance. All of a sudden in a cosmic reach around the world snags your scrot and flips you under its legs like a 1940s Jitter Bugger.

It is over.

You didn’t see it coming. Well you did but you thought you were so smart you could talk your way out of doom.

City Attorney A. (Anthony) Patrick Munoz esq. has to feel at this moment like he has been handed a schist sandwich and told to take a big old bite. Hows that taste Patrick?

The bond scam that was Project Phoenix, has been given the death nail as the Department of Finance has told the City of Twentynine Palms in no uncertain terms that not only can they not use the proceeds of the 2011 Series A and B bonds for Projects but that they are required to Defease the bonds themselves.

notobligationWe have been saying this from day one. The bonds serve no purpose other than lining the pockets of the 1%. They must be repurchased and defeased. The above quote puts it in plain language. This was a scam that had little chance of success. Like Rats the city elite bought into this scam lock, stock and barrel. RSG, Munoz and the Bonding company played a pretty little tune and the Rats followed the city’s children’s future in the balance….. Now it is time to pay the Piper.

There is going to be hell to pay. The city will loose its treasure.

For those of us who have been trumpeting the peril of  this scam for well over a year, we feel vindicated.

  1. A picture is really worth a thousand words.

And our brilliant Council not only no-bid awarded bloated consulting contracts to RSG, they actually hired Frank Spevacek as our City Manager! Talk about rats led to the shoreline…we are the sinking ship now with Frank at the helm! We win…our council is dumber than yours. We can’t wait til the Auditors get done with us…the City is giving good-bye notices today to 25% of our staff..please notice that the council did not cut their own overblown paycheck…or Frank’s. And our even-smarter residents just re-elected these clowns. They ployed these uninformed voters with lies about a $90 million reserve account, that is actually mostly unspent RDA money that the Gov will order to be used to defease our bonds….bonds of $240,000,000 and growing with interest over the next 20 years up to $460,000,000. Folk like us and in 29Palms and and other places where RSG trolled and victimized, we can all THANK FRANK!

BTW, I AM WRITING FROM LA QUINTA FOR THOSE WHO DID NOT KNOW WHERE FRANK WENT…IN CASE YOU ARE LOOKING FOR HIM.

  3. LINDAG LINDAG says:

And furthermore….(can you tell I’m fired up about Frank?)…at the November 29, 2011 29Palms Council meeting, it is reported that Frank told the audience that, “Because the bonds are a third-party contract the State cannot barr the tax increment revenue from being allocated to the repayment of bonds.” Why aren’t any of these cities who were being given this advice by Frank, suing RSG for malpractice?…these guys were paid hundreds of dollars per hour….hundreds of thousands of dollars in total from these cities…why isn’t anybody taking action against them and their insurance to try to re-coup some of this money?

    • Dan OBrien Dan OBrien says:

Excellent question…. What will happen is RSG and Rutan and Tucker will convince the city to piss even more money away suing the State……

      • Oversight Committee, where are you at in this play?

“Stop the insanity” means stop the flow of RDA funds. Defease meant to terminates the effect of RDA, not continue it.

In the long run it will pay off. A costly and lengthy law suit will only end in more defeat and it will cost huge sums of money.

The taxpayers looose, while the attorneys, consultanats and their many frieds will benefit. The courts have supported state shut-down legislation of the rda.

This may be one of the things newly elect Councilwoman Cora Heiser was referring to when she spoke about harmony, moving forward and forgettting the past.

It’s suicidal addiction to take on the State and the California Judicial System.

    • The public doesn’t have to approve RDA matters. That was a loophole early on RDA lobbiests plugged up.

That is a good deal for keeping the public in the dark like mushrooms. There needs to be a change of direction. That same goes for the controvearsial and flamboyant Town Manager of Yucca Valley.

It’s not their money and they don’t have to be accountable to the public. It’s as much about outside influence as it about insider contracts.

      • The oversight Committee oversees the same people who give them legal advice. The same people have been told no at least ten times. The same people have an agenda.

I see a direct conflict of competing interest.

The OC needs outside council. Pronto.

        There is no
