Yucca Valley, Ca.-Opinion-In a comment to a previous story, Town Manager, Mark Nuaimi, has admitted to conducting serial meetings with the Yucca Valley Town Council to discuss agenda items which is a clear violation of the Brown Act. He states he meets with each and every member prior to the meetings to review the agenda. In doing so, Nuaimi is violating the Brown Act by gathering a consensus under the guise of answering any questions the Councilmen may have while meeting behind closed doors.“As Town Manager, I typically meet with EVERY Town Council person weekly in order to keep them updated on projects, developments, answer questions, address issues, etc. During weeks when we have Town Council meetings, this includes Agenda Review.
During Agenda Review, I ask if there are any items that they need additional information on prior to or at the Town Council meeting or specific questions that they have. This way, I can ensure that Town staff are prepared to answer questions or have the information with them to be able to do so.
I also put together a (mostly) Weekly Update that highlights activities around the community. This weekly update is emailed to all Town staff, Town Council, and I believe many forward those updates to their contacts in the community.
The citizens of Yucca Valley can rest assured that their elected officials are well informed about what’s going on in Town.”

Mark has violated nothing. I have been down this road that you now are trying to travel and it will do you no good.
He can meet with a single council member and then another and then another it does not matter.
The problems you see with this type of management is clear but it is up to each elected council memebr to stop it – not the city manager.
The onus is on your Town Council not the city manager.
Unfortunately, Margo, there is no Brown Act Jail. There is also no Brown Act Police and city managers know these facts. The District Attorney has real criminals to prosecute and the FPPC is up to it’s elbows in complaints real and imagined against nearly every elected official. It doesn’t look like we’re going to see more money spent on ethics enforcement than already allotted. So, what is the answer? Persist in holding electeds and public officials (city managers) accountable. The public must be informed about the facts and you and Dan and Steve and Cora and the rest of the crew are doing a great job of doing that. However, it is vital to elect good honest and ETHICAL representatives. We must throw the bums out. Just remember. There is no Brown Act Jail and the enemy knows that. Now, get go out there and identify and cultivate someone to run in the next election and plan out an effective campaign to win.
