The Five HDWD Board of Directors met in “Closed Session with real property negotiators” to discuss Under Negotiation: Price and Terms of payment with FCI Lender Services, Inc.”
This illegal emergency meeting was called to discuss the real property negotiations of the Blue Skies Country Club! This was not an emergency as prescribed by the Brown Act for holding meetings with one hour notice. Citing the incorrect Government Code, the notice was sent out at 2:59 pm today calling for a meeting, an Emergency Meeting, to be held at 4:00 pm. The meeting lasted for 1 hour and 5 minutes reporting, ” No action taken, no further negotiations.”
That’s a good thing because this illegal meeting called by HDWD President Sarann Graham violated the Brown Act thereby voiding any action(s) that may have been taken.
Another waste of ratepayer funds for this so-called “Emergency Meeting.” This one hour illegal meeting will cost $625.00 to pay each Director their stipend of $125.00 for their attendance. A public information request will be submitted to report the additional legal fees charged for this matter.
Last Wednesday the HDWD Board of Directors went into closed session (again) with attorney John Brown of BBK, Best,Best & Krieger, (again) to discuss potential litigation regarding the water rights of the Blue Skies Country Club, again. The string of meetings, negotiations, conferences and closed sessions on this matter has continued for several years costing the ratepayers thousands of dollars. Blue Skies Golf Course-Pig in a Poke!
The last reportable action on January 4, 2012, was, “No further negotiations on the purchase of Blue Skies.” Blue Skies Golf Course-D.O.A. (Again!)
The recent foreclosure notice of the Blue Skies parcels published three weeks ago in the local newspaper may be responsible for this current activity.
FCI Lender Services, Inc. specializes in loan servicing, fund servicing and foreclosures for Hedge Funds, Investor LLC’s, Institution firms and Private Individuals.

Isaac, Margo ought to run to San Bernardino to file a Brown Act violation with the DA against the Board.
Why is the a surprise to anyone ?
It is part of the continuing wild goose chase, to purchase a bankrupt Golf Course (Free golf for the General Manger), to get marginal water rights. It will be a disaster, mis use of rate payer funds, and will NOT solve Yucca Valley’s access to a secure water supply. (If there is NO water underground, the water rights are a moot point!).
Another distraction for the Water District, from its core mission, of water supply and delivery.

Of course, let’s use another fly by night, dubious, and totally unknown money laundering operation, rather than focus using funds from a reputable, public agency source of funds.
Then again, when you are a used car salesman, failed real estate broker and purveyor of $ 29 disk drives from a failed startup, what do you expect from someone who has no public agency or utility district experience!
